Chaport & GDPR Compliance

What is the GDPR?

The GDPR (General Data Protection Regulation) is a new EU Regulation which will replace the 1995 EU Data Protection Directive (DPD) to significantly enhance the protection of the personal data of EU citizens and increase the obligations on organizations who collect or process personal data. It will come into force on 25th May 2018. The full text of the GDPR can be found here.

Does the GDPR apply to me?

While the current EU legislation (the 1995 EU Data Protection Directive) governs entities within the EU, the territorial scope of the GDPR is far wider in that it will also apply to non-EU businesses who a) market their products to people in the EU or who b) monitor the behavior of people in the EU. In other words, even if you’re based outside of the EU but you control or process the data of EU citizens, the GDPR will apply to you.

The changes within Chaport

We’ve added new features to our product to help ensure that your use of Chaport is compliant with GDPR:

  1. Chats Deletion/Export: You can now delete chats with their associated visitors’ information from within our app. You can also export individual chats in JSON format.
  2. Account Deletion/Export: Now you can also delete or export all personal data that belongs to your account – chats, visitors’ information, etc.
  3. Legal Text in Widget: We’ve added a legal text into our chat widget that you can customize to inform visitors how you use their personal data. Visitors will see this text before starting a chat:
  1. Marketing Permission Request: You can now ask visitors whether they agree to receive marketing information or not. When you request an email address, visitors will be required to answer your question by choosing ‘Yes’ or ‘No’. You’ll see their answer in our app or API.
  1. Data Processing Addendum (DPA): We’ve prepared a Data Processing Addendum. If you need to sign the DPA, please send a request to [email protected]
  2. GDPR-friendly Legal Documents: We’ve updated our Terms and Conditions and Privacy Policy to comply with the new requirements of GDPR.

What you need to do

If the GDPR applies to your company, there are few things you need to do:

  1. Make sure that your Terms and conditions and Privacy Policy clearly explain to your customers how you process their personal data with Chaport Live Chat.
  2. If your company is located in the EU, you can sign a Data Processing Addendum (DPA) with us. To do so, please send a request to [email protected].
  3. You can also add a legal text to the chat widget that will inform your visitors how you process their personal data, provided via chat. Visitors will see this text before starting a chat. To add the text, go to Settings → General and enable this setting:
  1. You have to request marketing permission if you want to use visitors’ email addresses for marketing purposes. To set up an automatic collection of marketing permissions, go to Settings → Chatbots → Email Request and enable this setting:
